Deadline missed in electric car tax case

A Garfield County District Court ruled Oct. 28 that the Oklahoma Tax Commission (OTC) could not revoke tax credits on low-speed electric vehicles sold by several Oklahoma dealerships. The electric car dealerships released a statement on Wednesday saying the 30 day deadline for the OTC to appeal the case has passed.

“By law the OTC had 30 days to appeal the ruling,” the release said. “The 30 days expired on Nov. 30 and the OTC has failed to file an appeal with the Supreme Court. The court ruling stands as the law of the land.”

Roger Gaddis of Ada Electric Cars said, “We’re grateful for the judge’s ruling in our case. From the beginning, we knew it was wrong for the tax commission to change the rules in the middle of the game. We are also thankful to the other electric vehicle dealers for joining the suit. This is a big win for the taxpayers of Oklahoma. This ruling means Oklahomans that want to purchase energy efficient, environmentally friendly electric cars can buy them with full confidence that they qualify for Oklahoma State income tax credites.”

The release said the tax credits in question amount to 50 percent of the vehicle’s price.

“The OTC first reneged on the tax credits, then they reneged on the settlement they offered us,” Gaddis said. “They’ve been bullying us repeatedly and we’ve had enough. This experience showed us that when government bueaucrats get out of control, you don’t just have to take it, you can fight them and win.”
